Garnishment

Garnishment is the culmination of a state court lawsuit to recover money from a person after they breach a contract. It is preceded by a summons and complaint served upon the person who owes the money, the defendant. The majority of people do not answer the complaint which causes a default on the defendant’s behalf. Generally speaking the plaintiff wins the case and is entitled to an order of judgment for the money owed. This order is reduced to a writ of garnishment that can be served on your employer, if you are employed, or your bank, if you have accounts, or against your future income tax refunds at the state and federal level, and in extreme instances against your personal property!
